General Conditions

These Terms of Sale must be examined before confirming the purchase on the website www.eeeshop.net.

The order confirmation implies their knowledge and acceptance. The Customer agrees and undertakes, once the on-line purchase procedure is completed, to print and keep these General Conditions, already viewed and accepted during the purchase process.

Each purchase transaction on the site www.eeeshop.net is governed by the provisions of art. 45 to art. 67 of the Italian Consumer Code (Legislative Decree 206/2005) reformed as a result of  the Italian Legislative Decree no. 21/2014 and, with regard to the Protection of Privacy, is subject to the legislation referred to in the Italian Legislative Decree 196/2003 and to the General Data Protection Regulation for 2016/679 EU (GDPR).

Definitions

1. "Us, us, ours", refer to EEESHOP.net Societa' Cooperativa (registered at the Chamber of Commerce of Naples, Italy with the number 842890)
2. "Client, Customer, Consignee, you, your, yours" refer to the person who purchases goods on the site www.eeeshop.net
3. "End-Consumer" is intended to mean the natural person who, by placing an order on our site, is acting for purposes that are outside the scope of his activity or profession.
4. "Website, site, webshop" refer to the website www.eeeshop.net
5. "Contract" refers to the contract for the sale of goods and / or services between us and the customer.

Description, availability and price of products

We are committed to ensuring accurate descriptions of the products offered at the time the buyer places the order on our site. The photos of the products may be indicative and may vary in colors or designs depending on availability. The technical specifications refer to the respective manufacturers' sites, are intended as indicative and may contain inaccuracies for which we are not responsible. The prices and availability indicated in this catalog are intended as long as stocks last and are subject to change due to market or other reasons. All prices for purchases made in the territory of the European Union include VAT. Discounts, coupons and promotions are never cumulative.

After the purchase, an e-mail confirming the order will be sent and that does not represent a final acceptance of the same. No sales contract exists between us and the buyer until the order is deemed accepted when the goods are dispatched. In case of unavailable goods or other problems the buyer will be contacted in advance. The price applied will be the price fixed at the time of order if the products are available or if they have not undergone particularly significant price changes. If not, we reserve the right to contact the buyer as soon as possible to cancel the order (without penalties for both parties) and possibly propose a product or an alternative price.

Claims notification

Any claim for goods not received must be notified in writing within 15 working days from the shipment date indicated in the shipping confirmation email.

Any claim for damaged goods, missing goods or goods not conforming to the description must be notified in writing within 3 working days from the actual delivery date.

Legal Warranty and  Returns Policy

All products offered for sale on our site are covered by the Legal Warranty or "2 years-warranty", contained in the art. 128 and following of the Italian Consumer Code. For more information, see the dedicated page on our website at this link.

The buyer can exercise the Right of Withdrawal following the purchase of goods on our site, in accordance with the Italian Consumer Code, Legislative Decree no. 206/2005 reformed by Legislative Decree no. 21/2014. Online Dispute Resolution (ODR)

EEESHOP.NET SOCIETA 'COOPERATIVA informs the user who holds the status of consumer as per art. 3, paragraph 1, lett. a) of the Italian Consumer Code, that it has been established a European platform for online resolution of disputes (eg. ODR platform). The ODR platform is available at this link.
Through the ODR platform the customer can consult the list of ADR institutions, find the link to the site of each of them and start an online resolution procedure of the dispute in which it is involved.

Limitation of liability

The purchaser releases the EEESHOP.NET SOCIETA 'COOPERATIVA from any responsibility deriving from the issue of incorrect tax documents due to errors in the data supplied by the Customer, since the Customer is solely responsible for the correct insertion.

It is understood that EEESHOP.NET SOCIETA 'COOPERATIVA assumes no responsibility for the use that the customer intends to make of the goods purchased. In case of defective or non-functioning goods EEESHOP.NET SOCIETA 'COOPERATIVA assumes the obligation to reimburse the customer the entire sum paid or, if necessary, to replace it.

In no case the EEESHOP.NET SOCIETA 'COOPERATIVA will be held responsible for lost profits due to the impossibility to use the purchased products. In case of damage during transport for uninsured shipments, EEESHOP.NET SOCIETA 'COOPERATIVA is not responsible. In case of replacement or refunds for incorrect orders, shipping costs will be deducted from the reimburse.

Force majeure

We will not be liable for any failure to perform, or delay in execution, any of our obligations under the contract if and to the extent that the failure or delay is caused by circumstances beyond our control.

Below is a summary list of the main Conditions of Sale applied:

1. By making the purchase, the buyer undertakes to accept and sign the terms of sale contained therein.

2. Within 24/48 hours of purchase, the buyer will receive by e-mail all instructions to make the payment (if not already made by Paypal or credit / debit card) and wait for the delivery of the item/s.

3. In case of purchase and payment with Paypal or Card, changes of destination address are not allowed after the completion of the checkout procedure.

4. In case of payment not made at the time of checkout, the buyer undertakes to contact the seller within 2 working days from the purchase. In case of non-payment and lack of communication from the buyer, we can consider the purchase as void and the item/s may no longer be available.

5. All prices for purchases made from within the territory of the European Union include VAT. The site www.eeeshop.net is not our only sales channel for which prices and availability may vary daily. At the time of purchase the price is blocked until receipt of payment but no later than a maximum of 2 days. After 2 working days from the purchase, if the payment has not yet been sent or has not been communicated, we reserve the right to consider the purchase as void.

6. The products on our site are proposed within the limits of the available quantities. The indications on the availability of the products come from our suppliers and are expressed at the time of ordering. Any kind of error and / or exceptional modification of these availabilities are independent of our will.

7. In the event that one or more products are unavailable, we will inform the customer by e-mail as soon as possible; the Customer may, if he wishes, cancel the order, in case the delay in the supply of the product is more than 15 working days.

8. When we receive the payment within 3 working days from the purchase, we confirm the order for the price shown in the order details. If the price of the item, in the days following payment, should vary, we will NOT refund or ask for any price difference in the MORE CATEGORY MANNER.

9. Cash on delivery payment is not accepted.

10. Shipment takes place according to the indicative terms declared on each product page. The time for order processing and packaging must be added to the shipping time.

11. The shipping cost varies depending on the items in the cart and is shown at checkout.

12. The items on sale are always available (except where expressly specified). Should there be any lack of stock in the warehouse and the lead time is more than 5 working days, the customer will be immediately notified and can decide whether to confirm or cancel the purchase.

13. For shipping by express courier it is necessary to provide a telephone number ALWAYS REACHABLE. In the event that a parcel goes into storage due to prolonged absence of the consignee, the costs of storage will be debited entirely to the recipient.

14. To make use of any compensation in case of damage to the package by the courier, you must always sign "WITH RESERVE" upon receipt of the package.

15. In case of receipt of damaged package by the courier and lack of "WITH RESERVE" signature and specification of visible damage, no action for damages can be taken by EEESHOP.NET SOCIETA 'COOPERATIVA.

16. The buyer has the right to exercise the right of withdrawal within 30 days of receiving the item, according to the terms of the law. The withdrawal will not be accepted if the product is no longer intact in its entirety and in its packaging. The right of withdrawal for SOFTWARE products or data storage media (hard disks, memory cards, etc.) is not accepted. More details on the exercise of the right of withdrawal can be found in the appropriate section.

17. In the event of a defective product, the buyer must contact customer support to obtain an RMA number for the return of the item. The shipping costs of the return of the item are at the expense of the purchaser. The costs of resending a replacement or repaired product are charged to us. Products returned back without an RMA authorization number will not be accepted and returned to the sender.

18. Defective products must be returned intact, not tampered with, complete in all their parts: original packaging and all the accessories included in the package (cd with software, cables, manuals, etc.). Returns of defective products that are not complete in their entirety will not be accepted.

19. Products returned back as defective, which, after inspection, do not present any manufacturing defect will be returned to the sender with expenses charged to him and a labor cost of 25.00 euros + VAT.

Jurisdiction

The present general conditions are reported, for what not expressly provided therein, to the combined provisions of Italian Legislative Decree 50 of 15/01/92 and of Legislative Decree 185 of 22/05/99. For any dispute that may arise in relation to the present general conditions and contracts stipulated on the basis of the same, limited to cases where the art. 14, Legislative Decree 22.5.1999, n. 185, the Court of Naples in Italy, will be exclusively competent.
